Blumberg Announces Lease Updates for NY Housing Stability and Tenant Protection Act of 2019


NEW YORK, October 22, 2019 ( – In the long history of New York landlord-tenant relations, the government has rarely cast such an extensive reversal of course in housing policy as it does in the Housing Stability and Tenant Protection Act (HSTPA). The HSTPA stops in its tracks the gradual conversion of units to the free market. Landlords will now have access to Summary Proceedings only for base rent and evictions. Actions to recover fees and costs must be brought separately, likely resulting in protracted litigation in the trial courts. These are only a few of the many provisions of the HSTPA that will make it more difficult for landlords to maintain the viability of their properties. Compliance with the law will be challenging. After an entity (either a business corporation, limited liability company or non-profit corporation) is formed, there is often a need to obtain a document which certifies that the entity is: a) still in existence; b) is up to date on its annual reports and franchise taxes; c) up to date on all of its statutory and administrative requirements.

First, you have to deal with the naysayers. Friends, families, and peers may try to talk you out of it. And it may not feel that way, but they have the best intentions.

Here’s the best advice you can get at this stage: Don’t listen to anyone who hasn’t started their own firm. Their discouragement is a form of protection, but unless they’ve done what you’re considering, they can’t know what they’re protecting you from. They can’t really know the dangers.

Regardless of where you are in your career, you can start your own law firm. Even if you’re straight out of law school, it’s possible. Blumberg Legal Form  119, formerly a 3-day notice, will be a 14-day notice. Rent demands required by law must be in writing, sent certified mail, and allow tenants 14 days to pay (RPL 711(2), 7-19

A new Blumberg Legal Form 309, will be an omnibus notice for 30, 60 and 90 day periods, 7-19

A new Blumberg Legal Form 304 will be a 5-day notice sent certified mail, RPL §235-E(d), 7-19

Blumberg Legal Form 307, 30-day notice, will be available for situations not affected by the Act, 7-19

Notices of Petition for Non-Payment or Holdover
